Patty Murray of Washington has formally requested that federal auditors review health care services in U.S. Immigration and Customs Enforcement facilities and the agency\u2019s compliance with its own detention standards.&nbsp;<\/p>\n<p>Murray\u2019s Thursday letter to the Government Accountability Office was sent several months after a 61-year-old detainee, Charles Leo Daniel, died at the Northwest ICE Processing Center, a detention center in Tacoma, <a href=\"https:\/\/washingtonstatestandard.com\/2024\/04\/01\/calls-for-federal-investigation-into-tacoma-detention-center-mount-amid-detainee-death\/\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">spurring calls for a federal investigation<\/a>.&nbsp;<\/p>\n<div class=\"multi-related-article-links manual-related embed-container u-sans u-border-t u-border-b u-border-light-gray mv-40 pv-20\">\n<div class=\"multi-related-article-links-wrapper u-dib u-w100\">\n<h3 class=\"related-article-label u-middle-gray u-dib u-upper u-bold font-tiny mb-0\"> Related <span class=\"u-off-black\"><\/span> <\/h3>\n<p> <button class=\"show-hide-btn u-border-n u-bg-white u-middle-gray u-dif u-navy-hfa hide\"> <icon class=\"icon-plus more-less-icon pr-1\"><\/icon> <\/p>\n<p class=\"icon-text font-list u-bold u-sans u-dib mb-0\">More<\/p>\n<p> <\/button> <\/div>\n<\/p><\/div>\n<p>\u201cICE has a responsibility to maintain safe, humane conditions for detained noncitizens,\u201d the letter reads.&nbsp;<\/p>\n<p>An ICE spokesperson told the Standard that the agency is \u201cfirmly committed to the health, safety and welfare of all those in its custody\u201d and that it has \u201climited detention resources to secure\u201d detainees.<\/p>\n<p>Daniel had numerous medical and psychiatric issues and often refused to take medications, according to ICE\u2019s <a href=\"https:\/\/www.ice.gov\/doclib\/foia\/reports\/ddrDanielCharlesLeo.pdf\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">detainee death report<\/a>, which is required by Congress. The Pierce County medical examiner <a href=\"https:\/\/www.knkx.org\/social-justice\/2024-06-10\/piece-county-medical-examiner-tacoma-ice-detainee-charles-leo-daniel-death-natural-causes-solitary-confinement\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">said in a report released last month<\/a> that Daniel died of natural causes related to high blood pressure and cardiovascular disease.<\/p>\n<div class=\"ad-container u-ofh u-bg-dark-off-white full-width-inset mb-4 mt-4 pt-0 ad-container-multiple body1\">\n<div class=\"ad-label font-micro u-tc u-mid-light-gray u-sans pv-10 u-upper\">Advertising<\/div>\n<\/p><\/div>\n<p>Northwest ICE Processing Center is run by a Florida-based company, The GEO Group, which contracts with ICE. The company is embroiled in two separate lawsuits brought by <a href=\"https:\/\/washingtonstatestandard.com\/2024\/03\/11\/court-blocks-state-inspections-of-federal-immigration-facility-in-tacoma\/\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">Washington state agencies attempting to inspect the Tacoma facility<\/a>.&nbsp;<\/p>\n<p>GEO has so far blocked state inspectors from entering the detention center by arguing in court that only federal authorities have the right to review standards for detainees.<\/p>\n<p>Researchers at University of Washington\u2019s Center for Human Rights have documented a range of troubling practices at the site, including allegations of medical neglect, unsanitary food and reports of sexual assault and abuse.<\/p>\n<p>Angelina Snodgrass-Godoy, director of the UW center, said that there\u2019s already more than enough research into ICE\u2019s practices in detention centers, including previous GAO audits. What she and advocates want to see is more action: \u201cWe don\u2019t need more studies,\u201d Snodgrass-Godoy said. \u201cWe need actual accountability markers [that] make sure people stop dying.\u201d&nbsp;<\/p>\n<p>\u201cIt\u2019s particularly disappointing coming from Sen. Murray, because she holds the purse strings,\u201d Snodgrass-Godoy said. \u201cShe has extraordinary access to the ability to hold ICE accountable.\u201d<\/p>\n<p>Snodgrass-Godoy also pointed to a recent report from several human rights groups, including the American Civil Liberties Union, that <a href=\"https:\/\/www.knkx.org\/social-justice\/2024-06-25\/ice-detention-center-in-tacoma-among-those-with-highest-number-of-deaths-aclu\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">found that<\/a> the facility has one of the highest death counts among immigration detention centers in the country.&nbsp;<\/p>\n<div class=\"ad-container u-ofh u-bg-dark-off-white full-width-inset mb-4 mt-4 pt-0 ad-container-multiple \">\n<div class=\"ad-label font-micro u-tc u-mid-light-gray u-sans pv-10 u-upper\">Advertising<\/div>\n<\/p><\/div>\n<p><a href=\"https:\/\/washingtonstatestandard.com\/2023\/11\/17\/immigrant-detainees-resort-to-hunger-strikes-in-protest-of-conditions-at-tacoma-facility\/\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">Hunger strikes by detainees<\/a> protesting conditions are common at the facility. La Resistencia, a group calling for the detention center\u2019s closure, has tracked six hunger strikes this year, including one involving 40 detainees that began three days ago.&nbsp;<\/p>\n<p>Northwest ICE Processing Center also uses solitary confinement more than any other immigration detention facility in the country, <a href=\"https:\/\/washingtonstatestandard.com\/2023\/11\/17\/immigrant-detainees-resort-to-hunger-strikes-in-protest-of-conditions-at-tacoma-facility\/\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">UW researchers say.<\/a>&nbsp;<\/p>\n<p>According to the researchers, Daniel\u2019s death on March 7 happened while he was in solitary confinement and he had been put in solitary confinement for four years while in ICE custody. Daniel also spent <a href=\"https:\/\/www.seattletimes.com\/seattle-news\/immigrant-who-died-in-ice-custody-spent-13-years-in-solitary-many-in-wa-prisons\/\" class=\"content-link\">nine years in solitary confinement while in Washington prisons<\/a>, The Seattle Times reported.&nbsp;<\/p>\n<p>Both ICE and GEO have noted Daniel requested to be put in solitary confinement. Snodgrass-Godoy said that reflects how Daniel may have felt in the facility: \u201cI don\u2019t think that\u2019s people loving solitary confinement. It\u2019s because people feel extraordinarily vulnerable.\u201d<\/p>\n<p>In a June 17 response to <a href=\"https:\/\/www.murray.senate.gov\/wp-content\/uploads\/2024\/04\/letter_solitary_confinement_in_immigration_detention_32924.pdf\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">a March letter<\/a> to the Department of Homeland Security from several U.S. senators, including Murray and Washington Democratic Sen. Maria Cantwell, the federal agency claimed it \u201cdoes not use, or place, detained noncitizens in solitary confinement.\u201d&nbsp;<\/p>\n<p>\u201cHowever, ICE does use segregation, which is a distinct practice, to ensure the welfare of detained noncitizens, as well as staff,\u201d wrote Patrick Lechleitner, deputy director at ICE.&nbsp;<\/p>\n<div class=\"ad-container u-ofh u-bg-dark-off-white full-width-inset mb-4 mt-4 pt-0 ad-container-single\">\n<div class=\"ad-label font-micro u-tc u-mid-light-gray u-sans pv-10 u-upper\">Advertising<\/div>\n<\/p><\/div>\n<p>\u201cUnlike conditions generally associated with solitary confinement, detained noncitizens in segregation experience basic living conditions akin to those provided to the general population,\u201d he added.&nbsp;<\/p>\n<p>What ICE calls \u201csegregation\u201d meets the United Nations\u2019 definition of solitary confinement. Snodgrass-Godoy said it\u2019s \u201cjust not true\u201d that people in solitary confinement experience the same basic living conditions as other detainees. While they may receive the same meals and have access to phone calls, \u201cThe key difference is they\u2019re isolated from individuals and kept in the cell for the overwhelming majority of the day,\u201d she said.&nbsp;<\/p>\n<p>\u201cThey\u2019re splitting hairs and trying to distract us from the reality,\u201d she said. \u201cIt\u2019d be foolish to fall into that trap of obfuscation.\u201d&nbsp;<\/p>\n<div data-section=\"seattle-news\" class=\"most-read-container module most-shared show u-border-t u-border-b u-border-light-gray embed-container mt-40 mb-40\">\n<div class=\"most-read-wrapper mb-17\">\n<h2 class=\"mrw-header pt-27\">Most Read Local Stories<\/h2>\n<\/p><\/div>\n<\/p><\/div>\n<p>Lechleitner said ICE uses two forms of \u201csegregation.\u201d The first is administrative, used when detained individuals are scheduled for release, waiting to hear back about various proceedings or to protect detained individuals, staff or the \u201csecurity of the facility.\u201d&nbsp;<\/p>\n<p>The second is disciplinary, which the agency says \u201conly serves as an effort to regulate the detained noncitizen\u2019s behavior and is imposed for a maximum sanction of 30 days per incident, except in extraordinary circumstances.\u201d&nbsp;<\/p>\n<p>Nationwide data presented in Lechleitner\u2019s letter shows the average length of stay across ICE\u2019s facilities from 2017 to 2023 in Special Management Units \u2014 or what the agency would call \u201csegregation\u201d \u2014 was 29 days.&nbsp;<\/p>\n<p><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2020\/02\/united-states-prolonged-solitary-confinement-amounts-psychological-torture\" target=\"_blank\" class=\"content-link external\" rel=\"noopener\">The United Nations considers <\/a>solitary confinement for more than 15 consecutive days a form of torture.&nbsp;<\/p>\n<p>ICE has placed people in Special Management Units a total of 20,675 times from 2017 to 2023 nationwide. While the agency notes that it used these units as overflow space during the height of the COVID-19 pandemic, contributing to high numbers, last year saw the most placements \u2014 3,800.<\/p>\n<p>UW\u2019s Snodgrass-Godoy said ICE\u2019s numbers don\u2019t line up with independent research, including her own, which often comes up with much longer average stays, based on how the data is calculated.&nbsp;<\/p>\n<p>The letter doesn\u2019t note ICE\u2019s methods for coming up with the numbers, and Snodgrass-Godoy believes they may be averaging numbers across all forms of ICE detention, including jail cells, rather than focusing on detention centers similar to Northwest ICE Processing Center.&nbsp;<\/p>\n<p>\u201cI just think they\u2019re throwing a bunch of categories together,\u201d Snodgrass-Godoy said. \u201cThat doesn\u2019t really tell you any meaningful information.\u201d&nbsp;<\/p>\n<p>GEO said in an April statement that Daniel\u2019s housing status was reviewed weekly and was evaluated by the ICE Health Services Corps to \u201censure that the decision to accommodate Mr. Daniel\u2019s request to remain in a Special Management Unit was safe from a mental health perspective.\u201d&nbsp;<\/p>\n<p>GEO referred the Standard\u2019s request for a statement to ICE. The ICE spokesperson said that the agency\u2019s \u201cnational detention standards and other ICE policies require facilities to provide comprehensive medical and mental health care from the moment noncitizens arrive at a facility and throughout their time in ICE custody.\u201d<\/p>\n<div class=\"extended-byline\">\n<div class=\"single-byline\"> <span class=\"name\"> Grace Deng <\/span> <\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Democratic Sen.
