Tennessee bill banning trans youth health care passes Senate committee

A Republican-backed bill to ban trans Tennessee youth from accessing puberty blockers, hormone treatments and other health care procedures passed out of a key Senate committee on Tuesday, the final hurdle before going to a full Senate vote.

A motion to send the bill to summer study, a move to effectively kill a bill for this current session, by Sen. Sara Kyle, D-Memphis, failed on a party line vote.

Filed as the first piece of legislation for the 113th Tennessee General Assembly, the bill has moved swiftly through both chambers, and could be up for a full vote as early as next week. The companion House bill, HB 1, is up for a final committee vote in the House on Wednesday.

Doctors would be prohibited under the law from providing any health care to minors “to identify with, or live as, a purported identity inconsistent with” their sex assigned at birth. Medical professionals could lose their licenses to practice under the bill.

The legislation also opens up a private right of action that would allow individuals who underwent similar treatments as a minor to sue their parents for damages. The attorney general could also sue a healthcare provider under the law.

Republican lawmakers have also proposed adding a provision to the Tennessee civil code that could classify allowing a minor to seek treatments for gender dysphoria as child abuse or neglect. The proposed language is broadly written and defines abuse as a minor sustaining, or in danger, of a “wound, injury, disability or physical or mental condition” caused by a medical procedure authorized by a parent or guardian.
